Performance Responsibilities

  • Waste Associates Responsibilities:
    Waste Associates is responsible for accurately communicating the details of the service request, including the size, type, and location of the dumpster; the timeline for delivery and pickup; and any specific customer requirements. Waste Associates must also ensure timely payment to the hauler based on agreed terms.
  • Hauler Responsibilities:
    The hauler is responsible for performing the requested services with professionalism and in compliance with local, state, and federal regulations. This includes timely delivery, proper placement, and safe removal of the dumpster, as well as disposal of waste in accordance with environmental laws and ordinances.

Liability

  • Waste Associates:
    Waste Associates is not liable for damages, injuries, or losses arising from the hauler’s operations.
  • Hauler:
    The hauler assumes full liability for operational risks, including property damage, injuries, or environmental violations caused by their equipment, employees, or actions while performing the contracted services.

Insurance Requirements

  • Waste Associates:
    Waste Associates must maintain appropriate insurance coverage to protect against risks inherent to its role, such as errors and omissions insurance, to address any miscommunication or contractual disputes with customers or haulers.
  • Hauler:
    The hauler must maintain adequate liability insurance, workers’ compensation insurance (if applicable), and vehicle/equipment coverage to safeguard against damages, accidents, or injuries during the provision of services. The hauler must provide proof of insurance upon request and ensure policies remain valid throughout the term of the agreement.

Mutual Obligations

Both parties agree to communicate promptly and resolve disputes professionally. Both Waste Associates and hauler must operate in good faith to ensure customer satisfaction and regulatory compliance.
